Our sites are not intended for children and we do not knowingly collect data relating to children.

We keep our privacy policy under regular review so please check it every so often. This version was last updated on 28th May 2025 . Any changes we may make to our privacy policy in the future will be posted on both our platform and website. 

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.

Our sites may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

●        Contact Data includes email address and/ or telephone numbers.

●        Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our site. 

●        Profile Data includes your username and password

●        Usage Data includes information about how you use our site, products and services. 

●        Employment/ Workplace Data includes experience, tenure, interests and any other information disclosed by you. 

●        Special Categories of Data includes health data disclosed by you. 

We also collect, use and share Aggregated Data such as statistical or demographic data research, benchmarking and analysis. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

Save as set out below, we will not collect Special Categories of Data unless this is required (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you provide us with Special categories of Data, you understand and give your explicit consent that we may collect, use and disclose this information to appropriate third parties for the purposes described in this Privacy Policy. If you provide personal information about other individuals such as employees or dependents, you must obtain their consent prior to your disclosure to us. 

Special Categories of Data (related to our online employee assessment)

Where you are an employee of an organisation that has engaged with us to provide services to help that organisation support the employee health and wellness in the workplace and deliver personalised confidential reports to its employees, we will (where you have access to our app and where we have consent from you) collect from you, personal data including special categories of data, such as health information about your height and weight, information about cigarette usage, exercise habits and other relevant lifestyle data and health information about diseases and medication use. We need this personal data in order to provide the services to you and to your employer i.e. to assess your health and wellness and personal wellbeing and provide a confidential report to you and anonymised and aggregated analysis information to your employer. All such data is handled in accordance with this Privacy Policy.                  

Conducting Data Analytics, Reports and Research (related to our online employee assessment)

We are an innovative business, which relies on developing a sophisticated knowledge base and focused services. We are not concerned with an analysis of identifiable individuals, and we take steps to ensure that your rights and the legitimacy of our activities are ensured through the use of aggregated or otherwise de-identified data.

In order for our software to carry out its analysis, we need your consent, Fruitful will anonymise and aggregate the personal data entered by you via the online employee assessment form and provide data analysis information to your employer to enable it to improve the health and wellness of the staff and the workplace. We ensure that your employer cannot identify you from the data analysis information we provide.

To ensure that Fruitful is able to deliver your reports and survey employee satisfaction, we may contact you via text message, email, telephone or push notifications. 

Where you are using our software, the health and lifestyle data that you record via our online employee assessment represents an important resource for research into health, medicine and lifestyle changes. We will therefore, use the personal data that you have provided via our online employee assessment to create aggregated and anonymised information and make this available to research projects, statistical analyses and trend analyses. However, please note that only aggregated and anonymised information is made available for research purposes. Researchers therefore cannot identify you from the information we provide.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with services). 

How is your personal data collected?

We use different methods to collect data from and about you including through:

Direct interactions. You may give us your data by filling in forms or by corresponding with us by post, phone, email, via our website , live chats or social media or otherwise. This includes personal data you provide when you:

●        request our services or where your employer requests our services;

●        set up a Fruitful online user account on our app;

●        complete the online employee assessment;

●        meet with or contact one of our staff;

●        are introduced to one of our staff by another contact;

●        contact us via our platform or website, or sign up for our newsletter etc;

●        request information about our services or other information or for materials to be sent to you;

●        respond to a survey, live chat etc;

●        contact us about a role at Fruitful;

●        give us some feedback. 

Automated technologies or interactions. As you interact with our sites, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal data by using cookies and other similar technologies.

We may use information obtained from cookies or similar technology.

Purposes for which we will use your personal data

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific legal ground we are relying on to process your personal data. 

Where we need to collect personal data by law, or under the terms of a contract and you do not provide that data when requested, we may not be able to perform the contract. In this case, we may have to cancel a service you have with us but we will notify you of this at the time.
